AB-003 – Direct-to-Consumer Alcohol Delivery
What manufacturers need to know about delivery, shipping changes, and new permit requirements starting July 1, 2024
Maryland law has changed how alcohol manufacturers can deliver products directly to consumers.
Starting July 1, 2024:
- Direct shipping through common carriers is no longer allowed (with limited exceptions)
- A new direct delivery permit is required to continue delivering to customers
This page explains what changed and what you need to do to stay compliant.
What changed
- You can no longer ship alcohol directly to consumers using common carriers
- You must apply for a direct delivery permit to continue delivering products
- New rules apply to deliveries, recordkeeping, and annual limits
Who This Applies To
This guidance applies to:
- Breweries
- Wineries
- Distilleries
Specifically, manufacturers who:
- Deliver products directly to consumers
- Previously shipped or delivered under prior authorization
What You Must Do
To continue direct-to-consumer delivery:
- Apply for a Direct Delivery Permit from ATCC
- Pay the required fee ($200 annually)
- Ensure you hold both:
- A manufacturing license
- A corresponding limited wholesaler license
Without this permit, direct delivery is not allowed.
What Is No Longer Allowed
Effective July 1, 2024:
- Manufacturers cannot ship alcohol directly to consumers using common carriers
Exception:
- Certain wineries with a valid direct wine shipper’s permit
Delivery Requirements
If you have a direct delivery permit, you must:
- Deliver only products you manufacture
- Use employees (not third-party carriers)
- Ensure delivery staff are:
- Over 18
- Certified in an approved alcohol awareness program
- Verify the recipient:
- Is 21 or older
- Is physically present
- Provides valid government-issued ID
Recordkeeping Requirements
You must:
- Maintain delivery logs for each order
- Keep records with invoicing documents
- Document:
- Product sold
- Volume/type of alcohol
- Recipient name and address
- Submit quarterly reports to ATCC
Delivery Limits
There are annual limits per customer/address:
- Wine: Up to 18 cases (9-liter cases)
- Beer: Up to 3,456 ounces
- Liquor: Up to 24 bottles (750ml)
Important Notes
- The direct delivery permit replaces previous authorizations
- Prior permissions expired June 30, 2024
- The new permit must be active to continue delivery
When to Apply
To avoid interruptions in service:
- Submit your application before delivery operations continue after July 1, 2024
