Requesting Records under the Maryland Public Information Act

The Legal and Legislative Division processes requests for access to public records of the ATCC under Maryland’s Public Information Act (PIA). Written requests should be sent to the ATCC PIA representative, Jeffrey Hann.

Submission of PIA Requests to the Maryland Alcohol, Tobacco, and Cannabis Commission

All requests for records maintained by the ATCC pursuant to the Maryland Public Information Act should be submitted via this website, email or mail.

The ATCC is committed to transparency and access to information, and will promptly respond to any requests for publicly available records. However, some records may be available only to particular authorized individuals, including records related to active criminal investigations or records which contain confidential commercial, financial, or tax related information. You may be required to provide proof of identity and/or authorization to receive the information requested. Records will be provided electronically whenever possible.

We ask that you provide as much detail as possible to identify the particular records you are seeking so that the records can be located efficiently. If a request requires more than two hours to locate and prepare the records, the ATCC may assess a fee that will be based on the pro-rated hourly rate of the staff which conduct the records search. Fees may be waived in certain cases of financial hardship or if waiver is in the public interest. To apply for a waiver on the basis of indigency, please submit an Affidavit of Indigency.

Types of records maintained by the ATCC

The ATCC licenses and regulates individuals and businesses which manufacture, import, or distribute alcoholic beverages, cigarettes, and tobacco products in Maryland. Generally ATCC license and permit holders operate as suppliers to retail businesses. The ATCC maintains records related to applications and issued licenses or permits for these businesses.

Retail businesses such as restaurants, bars, and packaged goods stores that sell alcohol or tobacco to consumers are licensed by authorities in the county or city where they operate, and the ATCC may not possess detailed records related to those locally issued licenses.

The Field Enforcement Division of the ATCC is a law enforcement agency which enforces Maryland laws on the sale and distribution of alcohol, tobacco, cannabis, and certain other regulated products. The ATCC maintains records of inspections and investigations conducted by FED agents.
