What sales representatives and agents need to know about permit requirements for malt beverage products

Maryland law requires individuals who sell or promote alcohol products to hold a solicitor permit.

This requirement was expanded to include individuals working with malt beverages (beer).

This page explains who needs a permit, who is exempt, and how to comply.

What you need to know

  • Solicitor permits are now required for individuals promoting or selling beer
  • The requirement applies to employees, agents, and representatives
  • Some individuals are exempt based on their role
  • Permits must be renewed annually

Who This Applies To

This guidance applies to:

  • Suppliers
  • Wholesalers
  • Nonresident dealers
  • Employees and agents involved in alcohol sales or promotion

What Changed

Previously, solicitor permits were required for:

  • Wine
  • Distilled spirits

This requirement now also applies to:

  • Malt beverages (beer)

Individuals promoting or selling beer must now hold a solicitor permit.

Who Must Have a Solicitor Permit

A solicitor permit is required for individuals who:

  • Sell alcohol products
  • Offer products for sale
  • Promote alcohol products

This includes individuals working for:

  • Suppliers
  • Wholesalers
  • Nonresident dealers

Who Does NOT Need a Permit

The following individuals are exempt:

  • Current solicitor permit holders (already covered for all alcohol types)
  • Wholesaler license applicants listed on the license
  • Delivery drivers or helpers who do not:
    • Take orders
    • Promote products

Permit Requirements

  • Cost: $50
  • Renewal: Annually
  • Permit Year: November 1 – October 31

Applications are accepted beginning August 1 each year.

Responsibilities of Businesses

Suppliers, wholesalers, and nonresident dealers:

  • Must ensure employees and agents obtain required permits
  • Remain responsible for the actions of their representatives

Important Dates

  • Law effective: October 1, 1998
  • Applies to permits issued starting: November 1, 1998
