AB-29 – Beer Franchise Fair Dealing Act Reporting Requirements
What suppliers and wholesalers must file under Maryland’s updated beer franchise system
Maryland updated its system for tracking beer franchise agreements, and all suppliers of malt beverage products must now submit updated franchise filings for every brand distributed in the state, which will replace all existing records.
What you need to know
- All beer franchise data must be resubmitted
- Each brand, wholesaler, and territory must be reported
- New filings will replace all existing records
- Submissions must be completed by the deadline
Who This Applies To
This guidance applies to:
- Suppliers of malt beverage (beer) products
- Non-resident dealers
- Maryland wholesalers
Including wholesalers who:
- Subdistribute products
- Act as a secondary source for other wholesalers
What Changed
Maryland replaced its previous beer franchise reporting system with a new system.
To ensure accurate data:
- All existing franchise information must be resubmitted
This includes all brands currently distributed in Maryland.
What You Must File
You must submit:
- A beer franchise form for each brand
Each filing must include:
- Assigned wholesaler(s)
- Territory information
Filings must:
- Not conflict with existing agreements
- Comply with the Maryland Beer Franchise Fair Dealing Act
Special Requirements for Wholesalers
Wholesalers must also file if they:
- Subdistribute products to another wholesaler
- Serve as a secondary source for another wholesaler
Required Form
- Form: 528 ATTD (Revised Beer Franchise Form)
You may:
- Duplicate the form as needed
- Use your own format only if it matches the required structure
Forms submitted in a different format will not be accepted.
Filing Deadline
- Due date: February 1, 2001
Early submission is encouraged to support processing.
Important Requirement
- Your new filings will replace all existing franchise filings
This means:
- All current data must be included
- Incomplete filings may result in missing or incorrect record
Important Notes
- This is a full system reset, not a partial update
- All brands must be included in your submission
- Ensure all information is complete and accurate
