What suppliers, wholesalers, and wineries must file and when following reinstated price filing rules

Maryland has reinstated alcohol price filing requirements following a court decision.

Businesses that sell wine and distilled spirits must now submit pricing information on a set schedule and follow updated filing procedures.

This page explains what must be filed, when it is due, and how to stay compliant.

What you need to know

  • Price filing requirements are back in effect
  • You must submit pricing by specific deadlines
  • Different requirements apply depending on your filing history
  • Products cannot be sold if prices are not filed 

Who This Applies To

This guidance applies to:

  • Suppliers
  • Maryland wholesalers
  • Maryland wineries
  • Non-resident dealers

What Changed

A court ruling removed a previous injunction, allowing Maryland to enforce:

  • The 30-day post-and-hold price filing system
  • The ban on quantity discounts

These requirements are now back in effect.

Filing Schedule

  • Next price filing:
    • Due: December 5, 2005
    • Effective: January 1, 2006

Ongoing schedule:

  • File by the 5th of each month
  • Prices take effect on the first day of the following month

What You Must Submit

Depending on your situation:

If you previously filed prices:

  • You will receive a Turn-Around Document
  • You must:
    • Update it
    • Return it by the deadline

If you did NOT previously file prices:

  • You must submit a New Item Schedule
  • One for each brand you intend to sell

All filings must reflect prices effective January 1, 2006.

Required Forms

You may need:

  • Turn-Around Document (for existing products)
  • New Item Schedule (for new or previously unfiled products)
  • FOB/wholesaler assignment forms (for suppliers)

Forms are available through the Comptroller’s Office.

Important Requirement

Any wine or distilled spirits:

  • Not on file by January 1, 2006
  • Cannot be sold in Maryland

Compliance Requirements

Businesses must:

  • Submit all required filings on time
  • Ensure all product pricing is properly filed
  • Follow the established monthly filing schedule

Failure to comply may result in products being prohibited from sale.
