What in-state and out-of-state wineries need to know about new licensing options in Maryland

Maryland law created new licensing options for certain wineries to sell and deliver wine directly to retailers.

These include a limited wine wholesaler license for in-state wineries and a nonresident winery permit for out-of-state wineries.

This page explains who qualifies, what each allows, and the rules that apply.

Who This Applies To

This guidance applies to:

  • Maryland limited wineries
  • Out-of-state wineries selling into Maryland

What Changed

Maryland created:

  • Class 6 Limited Wine Wholesaler License (W6)
  • Non-resident Winery Permit (NW)

These replace prior guidance and provide new pathways for distribution.

Class 6 Limited Wine Wholesaler License (In-State)

This license is available to:

  • Maryland Class 4 limited wineries
  • Producing 27,500 gallons or less annually

This license allows:

  • Sale and delivery of wine to Maryland retailers

Restrictions:

  • Cannot also distribute through another Maryland wholesaler

Non-resident Winery Permit (Out-of-State)

This permit is available to:

  • Wineries located outside Maryland
  • Producing 27,500 gallons or less annually

This permit allows:

  • Sale and delivery to Maryland retailers
  • Use of a permitted third party for transport and delivery

Restrictions:

  • Cannot also hold a nonresident dealer’s permit
  • Cannot distribute through a Maryland wholesaler at the same time

Fees

  • License fee: $50
  • Permit fee: $50

Both options have the same cost and similar privileges.

Application Process

To apply:

  • Use the appropriate application forms:
    • COM/ATTB-007 (Class 6 license)
    • COM/ATTB-010 (Nonresident permit)

Forms are available through the Comptroller’s Office.

Compliance Requirements

License and permit holders must comply with:

  • Maryland alcohol laws
  • Tax requirements
  • Credit control regulations
  • Price filing regulations

Important Notes

  • These licenses apply only to wineries under the production limit
  • Businesses must choose one distribution method and cannot combine options
  • Additional regulatory requirements apply to sales and reporting
