What wineries and permit holders need to know about expanded direct sales authority

Maryland law now allows certain wineries and permit holders to sell wine directly to retailers in Montgomery County, removing previous restrictions and expanding distribution options across the state.

What you need to know

  • Direct sales to Montgomery County retailers are now allowed
  • Applies to Class 6 limited wine wholesalers and nonresident winery permit holders
  • Previous restrictions on Montgomery County sales have been removed
  • The law took effect immediately upon signing

Who This Applies To

This guidance applies to:

  • Class 6 limited wine wholesaler license holders
  • Nonresident winery permit holders

What Changed

Maryland law now allows:

  • Direct sales of wine to all properly licensed retailers, including those in Montgomery County

Previous Requirement

Before this change:

  • Sales to Montgomery County retailers were restricted
  • Sales could only be made to:
    • The Montgomery County Department of Liquor Control (DLC)

What Is Now Allowed

Eligible permit holders may now:

  • Sell wine directly to retailers in Montgomery County
  • Sell to retailers statewide without the previous limitation

Effective Date

  • The law took effect: April 10, 2007 (upon signing)

  • Update distribution practices to include Montgomery County retailers
  • Review agreements and sales processes
  • Take advantage of expanded market access

Important Notes

  • Retailers must still be properly licensed
  • All other applicable laws and regulations still apply
