Understand new legal requirements for accurate reporting of cigarette and RYO tobacco sales

Maryland law now requires cigarette wholesalers to submit complete and accurate monthly sales reports for cigarettes and roll-your-own (RYO) tobacco. Failure to report correctly may result in enforcement action and license penalties.

What you need to know

  • You must report complete and accurate sales data

  • Reports must include cigarette and RYO tobacco by brand and manufacturer

  • Use the current version of Form 608-3

  • Incomplete reporting may lead to license penalties

Licensed wholesalers of cigarettes and roll-your-own tobacco in Maryland

What Changed

  • New law clarifies that all reported sales data must be complete and accurate

Requirements / Process / Rules

  • Submit Form 608-3 each month

  • Report all cigarette and RYO sales from the prior month

Reports must include:

  • Brand family

  • Manufacturer

  • Quantity sold

  • Submit each manufacturer’s products on a separate page

  • Use the current version of Form 608-3 (revised March 2021)

What Is Now Allowed / Not Allowed

Allowed:

  • Reporting complete and accurate sales information

Not allowed:

  • Submitting incomplete or inaccurate data

  • Selling or stamping products not listed in the Maryland Tobacco Directory

Effective Date

  • October 1, 2023

  • You must ensure products are listed in the state directory

Important Notes

  • Only products listed in the Maryland Tobacco Directory can be sold
