Advisory 24-005: Wine & Distilled Spirits Distributor Appointments

This advisory explains the process for changing a wine or distilled spirits distributor appointment in Maryland. Suppliers must provide notice to both the licensed wholesaler and the Office of the Executive Director (OED), and specific information must be included to begin the required review period.

  • Non-Resident Dealers

  • Maryland Manufacturers

  • Licensed wholesalers involved in distributor changes

  • Suppliers of wine and distilled spirits brands in Maryland

Requirements / process / rules

Under COMAR 14.23.01.08, a supplier that wants to change the licensed wholesaler selected or franchised to distribute a wine or distilled spirits brand in Maryland must:

  • Notify the licensed wholesaler

  • Notify the OED

  • Send the notice by Registered Mail

  • Wait for the required 30-day period to begin after OED receives the notice

Once the OED receives the notification, all parties will receive written notice confirming the intent and the start of the required 30-day period.

Required information

The notification must:

  • Be on company letterhead

  • Include an authorized signature

  • Be submitted to the OED

The notification must also include:

  • Full corporate name of the Non-Resident Dealer or Maryland Manufacturer

  • Related permit number

  • Contact name

  • Phone number

  • Email address

  • Full corporate name of the incoming wholesaler

  • Full corporate name of the outgoing wholesaler

  • License numbers for both wholesalers

  • All affected product brand names
